Rentsabi Usage Policy

You represent and warrant that the owners of the phone numbers, messaging addresses, and email addresses you initiate communications to through Content Driven Solutions LLC service known as "Rentsabi" (also referred to herein as "the Services") have consented or otherwise opted-in to the receipt of such communications and broadcasts as required by any applicable law or regulation.

For messages, you agree that you will include clear opt-out/unsubscribe information on your messages when required to do so by any applicable law or regulation and otherwise adhere to the Consumer Best Practices Guidelines promulgated by the Mobile Marketing Association, if applicable to your messages. Rentsabi will automatically include email opt-out links and your mailing address in email campaigns that you send. You agree not to take action that circumvents this automatic inclusion.

You agree to familiarize yourself with and abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account, including without limitation the content of the messages and emails that you create and initiate through Rentsabi. This is not intended to nor shall it be deemed to constitute legal advice. You should consult a lawyer for legal advice on your texting, calling, and email practices. Carrier Fines

U.S. carriers have created A2P (Application to Person) routes for 10-digit long code phone numbers (A2P 10DLC) in order to give senders a sanctioned channel for messaging that will ensure consumers reliably receive wanted messages. Message campaigns that are non-compliant with carrier requirements may be subject to carrier penalties for the offending traffic. If these penalties are assessed, they will be passed through to you the customer. Currently, T-Mobile has stated messages violations, as also reflected in Rentsabi's Usage Policy and the above linked T-Mobile Code of Conduct – including spam, phishing, and SHAFT violations (Sex, Hate, Alcohol, Firearms, Tobacco) may result in a fine of $10,000 per violation. Rentsabi will report these violations to customers and pass these fees through directly on behalf of the carriers.

Rentsabi will enforce its policies independently from carriers through outreaches and other remediation efforts, including account restrictions or suspension. However, Rentsabi makes no guarantee that it will intervene in your non-compliant traffic before carriers levy the fees.

The Telephone Consumer Protection Act (“TCPA”), the Federal Trade Commission, the Federal Communications Commission and various state laws, rules and regulations place restrictions on certain types of SMS or MMS messages. Rentsabi is in no way attempting to interpret any laws, rules, or regulations. This information is provided merely as a courtesy and is not intended to replace your responsibility to familiarize yourself with and abide by the legal requirements pertaining to your messages prior to using Rentsabi. You are ultimately responsible to make your own informed decisions regarding your messages.

In addition, the CAN SPAM Act establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations.

Consent Requirements

While consent is always required and the consent requirements noted above are generally the safest path, there are two scenarios where consent can be received differently.

Contact initiated by an individual

If an individual sends a message to you, you are free to respond in an exchange with that individual. For example, if an individual texts your phone number asking for your hours of operation, you can respond directly to that individual, relaying your open hours. In such a case, the individual’s inbound message to you constitutes both consent and proof of consent. Remember that the consent is limited only to that particular conversation. Unless you obtain additional consent, don't send messages that are outside that conversation.

Informational content to an individual based a prior relationship

You may send a message to an individual where you have a prior relationship, provided that individual provided their phone number to you, and has taken some action to trigger the potential communication, and has not expressed a preference to not receive messages from you. Actions can include a button press, alert setup, appointments, or order placements. Examples of acceptable messages in these scenarios include appointment reminders, receipts, maintenance status updates, updates regarding leasing approval status, updates regarding their specific rental unit, package pick up notices.

The message can't attempt to promote a product, convince someone to buy something, or advocate for a social cause.

Periodic Messages and Ongoing Consent

If you intend to send messages to a recipient on an ongoing basis, you should confirm the recipient’s consent by offering them a clear reminder of how to unsubscribe from those messages using standard opt-out language (e.g. send "STOP"). You must also respect the message recipient’s preferences in terms of frequency of contact. You also need to proactively ask individuals to reconfirm their consent as set forth by local regulations and best practices.

Identifying Yourself as the Sender

Every message you send must clearly identify you (the party that obtained the opt-in from the recipient) as the sender, except in follow-up messages of an ongoing conversation.

You shall schedule your text, messaging service messages and calls responsibly and in a manner that is courteous to the recipients pursuant to local, state, national, and international calling time rules and regulations. You are solely responsible for obtaining any rights or licenses to any data, including without limitation sound files, pictures or videos for inclusion in any outbound communications. If you are unfamiliar or unclear on the legalities of any message that you intend to initiate through Rentsabi, you must consult with your attorney prior to your use of Rentsabi.

You accept that the Services are provided for professional use only, and you agree that your use of the Rentsabi shall not include:

You agree to provide legally required contact information in any outbound message when and where required by any applicable local, state, national or international law or regulation. You further agree that Rentsabi is, under no circumstances, responsible for the contents and/or accuracy of your messages and Rentsabi will only transmit them on a basis of good faith that you use Rentsabi in accordance with these Terms.

You are solely responsible for providing the content of all messages initiated by you through Rentsabi. Rentsabi will not be liable for any misuse of the Services by you. Rentsabi is not responsible for the views and opinions contained in any of your messages or broadcasts.
